BY ENTERING INTO THIS SWEEPSTAKES (THIS “GAME SWEEPSTAKES“), YOU AGREE TO THESE OFFICIAL SWEEPSTAKES RULES (THE “OFFICIAL RULES“), WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THE OFFICIAL RULES INCLUDE CERTAIN RELEASES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES, INCLUDING A WAIVER OF YOUR RIGHT TO A TRIAL BY JURY.

SPONSOR: This Sweepstakes is sponsored by Carolina Trust Federal Credit Union (the “Sponsor“), with its headquarters located at 1010 21st Ave N, Myrtle Beach, SC 29577. This Sweepstakes is not sponsored, endorsed, administered, or operated by Facebook, Myrtle Beach Bowl or any of their affiliates or subsidiaries.

ELIGIBILITY: This Sweepstakes is only open to individuals who satisfy each of the following requirements (each an “Eligible Individual“): (i) must be an individual who is a legal resident of the United States and who is a legal resident of the state of South Carolina or North Carolina at the time of entry and of determination of the winner of the Sweepstakes; and (ii) must be at least 18 years of age at the time of entering the Sweepstakes; and (iii) must not be an employee of Sponsor or any division of Sponsor, or any of its parent, affiliate, or subsidiary entities; and (iv) must not be an immediate family member (spouse, parent, child, or sibling or spouse of any of them) of, or other individual living in the same household as, an employee of Sponsor or any division of Sponsor, or of any of its parent, affiliate, or subsidiary entities.

START/END DATES: This Sweepstakes begins at 12:01 a.m. EST on December 7, 2023 and ends at 11:59 p.m. EST on December 10, 2023 (collectively the “Promotion Period“).

HOW TO ENTER (NO PURCHASE NECESSARY): No Purchase Necessary to enter the Sweepstakes. Limit one (1) Entry (as defined below) per Eligible Individual. Eligible Individuals may enter this Sweepstakes during the Promotion Period by making an entry (each an “Entry” and collectively the “Eligible Entries“) during the Promotion Period using any of the following entry methods:

(a)        Form Entry: Eligible Individuals who, during the Promotion Period, submit the form above will receive one (1) Entry into this Sweepstakes. Limit one (1) Entry per Eligible Individual (regardless the number of  Entry methods used, by the Eligible Individual).

(b)        Email Entry: Eligible Individuals who, during the Promotion Period, send an email to deptmarketing@carolinatrust.org, with: (i) a subject line stating: “Sweepstakes Entry” and: (ii) the following information in the body of the email: the Eligible Individual’s name, mailing address, and telephone number, will receive one (1) Entry into this Sweepstakes. Limit one (1) Entry per Eligible Individual (regardless the number of emails sent, or other Entry methods used, by the Eligible Individual).

(c)        Branch Entry: Eligible Individuals who, during the Promotion Period, submit to a Sponsor employee at a Sponsor branch location a 3×5 notecard with the Eligible Individual’s name, address, email address, and telephone number legibly printed thereon, will receive one (1) Entry into this Sweepstakes. Limit one (1) Entry per Eligible Individual (regardless the number of notecards submitted, or other Entry methods used, by the Eligible Individual).

By submitting an Entry into this Sweepstakes, each Eligible Individual fully and unconditionally agrees to be bound by these Official Rules and the decisions of Sponsor and its appointed agents, which will be final and binding in all matters relating to this Sweepstakes. Sponsor is not responsible for incorrect or inaccurate capture of entry information, technical malfunctions, lost or delayed data, any interrupted or unavailable network server or other connections or communications, any failed telephone or computer transmissions, jumbled, scrambled or misdirected entries or transmissions, software or hardware malfunctions, interruptions, defects, or failures, or any errors, omissions, interruptions or deletions of any kind due to electronic, human, mechanical, printing, production or technical errors or other causes, or for any damage to a person’s computer. Sponsor is not responsible for late, incomplete, invalid, unintelligible, or illegible entries, each of which will be disqualified. All Eligible Entries become the exclusive property of Sponsor and none will be acknowledged or returned. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and disqualify any Eligible Individual using such methods. Each Entry submitted in violation of these Official Rules will be void.

RANDOM DRAWING / ODDS: One (1) potential winner from the Eligible Entries received during the Promotion Period will be randomly selected in a drawing conducted by the Sponsor on or about  December 12, 2023 Odds of winning depend on the total number of Eligible Entries received during the Promotion Period.

GRAND PRIZES / RESTRICTIONS: One (1) Grand Prize will be awarded. Subject to the Official Rules, one (1) Potential Winner(s) will be awarded the following prizes (collectively the “Grand Prize“):

(a) 5 tickets to the game listed below (the “Game“);

Transportation to and from the Game is not included. Dates of the Games are subject to change. The Tickets must be used on the dates specified by Sponsor or they will be forfeited. Sponsor reserves the right to substitute all or any portion of the Grand Prize with a prize of comparable or greater value if the Grand Prize, or any portion thereof, is unavailable, cannot be awarded as described for any reason, or if the Game is cancelled, postponed, not permitted to have fans in attendance, or if fan attendance is limited in connection with Covid-19. All expenses not specifically mentioned in the Grand Prize are not included and are solely the Potential Winner’s responsibility.

Limit of one (1) Grand Prize per person/household. No more than one (1) Grand Prize will be awarded. Each Grand Prize is non-transferable and non-assignable and no substitutions or cash redemptions are permitted; except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor will not replace any lost or stolen Grand Prizes. The Potential Winner is solely responsible for all applicable federal, state and local taxes in connection with the Grand Prize, including taxes imposed on his/her income. If the Potential Winner is ineligible or unavailable to receive the Grand Prize during the designated time frame, the Grand Prize will be forfeited and an alternate Potential Winner may be randomly selected (time permitting) from among all remaining Eligible Entries.

Ticket Restrictions: Sponsor makes no promises or representations regarding the location of the seats or parking spot associated with the Tickets, or that any Tickets will be seated together. Any unused Tickets will be forfeited. All Tickets, and entry and admission into the stadium pursuant to any Tickets, are subject to all further terms and conditions set forth by Myrtle Beach Bowl, including but not limited to removal from the Game if any individual acts in an unsportsmanlike or inappropriate manner or otherwise violates any rules of Myrtle Beach Bowl. Any and all taxes of any kind, fees, insurance, and other costs including, without limitation, costs for transportation, food or beverages, are the sole responsibility of the Potential Winner. Sponsor is not responsible for any lost or stolen Tickets. Tickets are only valid for the game and seats for which they are issued.

GRAND PRIZE NOTIFICATIONS / DELIVERY / TAXES:

(a)        Sponsor will notify (the “Notification“) each Potential Winner as follows: (i) Sponsor will post the name of each Potential Winner via email along with instructions for contacting Sponsor; and (ii) if the Potential Winner submitted an Entry via Email Entry or Branch Entry as described in Section 3(b) or Section 3(c) above, such Potential Winner will be notified by Sponsor by phone at the phone number listed on the Potential Winner’s Entry form. Within five (5) days of the Notification, the Potential Winner will be required to provide Sponsor a completed, signed, and notarized Affidavit of Eligibility and Liability/Publicity Release, in such form as is provided by Sponsor, fully signed by the Potential Winner (the “Paperwork“).

(b)        If the Potential Winner: (i) fails to respond to the Notification, or is unable to be contacted by Sponsor using the information provided in the Entry (or the Notification is returned undeliverable), within three (3) business days after the drawing for the Grand Prize; or (ii) fails to return the properly completed Paperwork within three (3) days of the Notification; or (iii) is found to be ineligible pursuant to, or fails to meet the requirements of, these Official Rules; or (iv) does not comply with these Official Rules; or (v) fails to pick up the Grand Prize within the allotted time set forth by Sponsor, such Potential Winner and his/her Entry will be disqualified and another Potential Winner will be randomly selected from the remaining Eligible Entries received.

(b)        Upon Sponsor’s verification of: (i) the Potential Winner’s eligibility and compliance with these Official Rules; and (ii) verification of receipt of the properly completed Paperwork by the Potential Winner within the allocated time frame, Sponsor will coordinate to make available the Grand Prize for pickup at one of Sponsor’s branch locations; provided, however, that Sponsor, in its sole discretion, shall make the final determination of the delivery date and delivery location of the Grand Prize.

(c)        The value associated with the Grand Prize is taxable as income and the Potential Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Grand Prize. The Sponsor may report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Potential Winner and to the Potential Winner in the form of a Form 1099.

CONDITIONS:

This Sweepstakes is conducted in English. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and any short-form rules, advertising materials, or other Sweepstakes-related materials, the terms and conditions of these Official Rules shall prevail, govern, and control. Sponsor reserves the right to disqualify permanently from this Sweepstakes any entrant it believes has violated these Official Rules and verify eligibility of entrants. Failure to comply with these Official Rules may result in disqualification from this Sweepstakes. All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor.

In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate this Sweepstakes and randomly draw a Potential Winner from those remaining Eligible Entries received up to the cancellation/suspension date. Sponsor may prohibit an entrant from participating in this Sweepstakes or winning the Grand Prize if, in its sole discretion, it determines that such entrant is attempting to undermine the legitimate operation of this Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, pandemic, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes and randomly draw a Potential Winner from those remaining Eligible Entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

Winning a Grand Prize constitutes permission for Sponsor and its agents to use the Potential Winner’s name, address (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Sweepstakes only, without further compensation, unless prohibited by law.

LIMITATION OF LIABILITY; INDEMNIFICATION AND WAIVER; CLASS-ACTION WAIVER:

By participating in this Sweepstakes, to the maximum extent permitted by applicable law, each entrant, Eligible Individual, and each Potential Winner releases, discharges, and agrees to indemnify and hold harmless the Sponsor and each of its officers, directors, members, managers, employees, representatives, and agents from and against any and all actions, claims, losses, damages, expenses, injuries, and loss of life to any persons or property that are caused by, arise from, or are related to, directly or indirectly, the operation of or participation in this Sweepstakes or the receipt, acceptance, possession, misuse, or use of the Grand Prize.

To the fullest extent permitted by applicable law, each entrant, Eligible Individual, and each Potential Winner agrees that any and all claims, actions, demands, and causes of action (collectively “Claims“) arising out of or in any way relating to this Sweepstakes or the Grand Prize shall be made individually, and not as a member of a class or otherwise in any form of class action.

To the fullest extent permitted by applicable law, each entrant, Eligible Individual, and each Potential Winner agrees that any and all Claims, judgments, and awards in connection with this Sweepstakes shall be limited to only the actual out-of-pocket costs incurred with entering this Sweepstakes, and in no event may any attorneys’ fees be claimed, included, or awarded.

SPONSOR SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THIS SWEEPSTAKES.

THE GRAND PRIZE PROVIDED IN CONNECTION WITH THIS SWEEPSTAKES IS PROVIDED “AS IS” AND SPONSOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE, EACH OF WHICH ARE EXPRESSLY DISCLAIMED.

WINNERS LIST:

A list of the Grand Prize winners may be obtained after the end of the Promotion Period by sending an email request for such information to Sponsor at deptmarketing@carolinatrust.org, within six (6) months following the end of this Sweepstakes.

11.MISCELLANEOUS:

This Sweepstakes shall not be published without the written permission of the Sponsor.

If any provision hereof is determined to be invalid or unenforceable, that provision shall be deemed severed from the remainder of these Official Rules, and the remaining provisions of these Official Rules shall continue in full force and effect. These Official Rules and the Paperwork constitutes the entire agreement, and supersedes all prior agreements and understandings, oral and written, between each Eligible Individual and Sponsor with respect to this Sweepstakes.

These Official Rules shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflicts of law principles. Any legal suit, action or proceeding arising out of or related to these Official Rules or the matters contemplated hereunder shall be brought in and each party irrevocably submits itself to the exclusive jurisdiction of the state and federal courts of the State of South Carolina sitting in Horry County, South Carolina, and irrevocably agrees that all claims in respect of such action or proceeding shall be heard and determined only in and by either of the state or federal courts sitting within Horry County, South Carolina. Furthermore, each Eligible Individual, by participating in this Sweepstakes, hereby irrevocably waives and agrees not to assert by way of motion, as a defense or otherwise in any such action or proceeding, any claim that such party is not personally subject to the jurisdiction of the state or federal court sitting in Horry County, South Carolina, that such action or proceeding is brought in an inconvenient forum, that the venue of such action or proceeding is improper or that these Official Rules may not be enforced in or by such state or federal court sitting in Horry County, South Carolina. EACH ELIGIBLE INDIVIDUAL AND POTENTIAL WINNER HEREBY WAIVES ANY RIGHT HE OR SHE MAY HAVE TO A JURY TRIAL ARISING FROM ANY DISPUTES RELATED IN ANY WAY TO THESE OFFICIAL RULES, THIS SWEEPSTAKES, OR THE GRAND PRIZE.
